Not a biography

The Story Line Does Not Make Any Sense

According to the article, the Governor of California was at sea on a naval ship, and his whereabouts were unknown, thus inhibiting the ability to seek a stay of execution. This makes absolutely no sense. Pursuant to the California Constitution, "[t]he Lieutenant Governor shall act as Governor during the impeachment, absence from the State, or other temporary disability of the Governor or of a Governor-elect who fails to take office." So, if the Governor was out of the state at sea, Abbott's lawyers should have sought relief from the Lieutenant Governor. If the recitation in the article is true, then Abbott's execution may have been due to the incompetence of his counsel, and not to any unjustified reliance on circumstantial evidence. Further, if the Supreme Court of California set the execution prior to the expiration of the time available for filing a petition of writ of certiorari to the United States Supreme Court, Abbott's lawyers should have sought relief, either from the state supreme court or the United States Supreme Court. According to the article, the time for filing a petition for writ of certiorari is 90 days, and the State of California set the date of execution for 2 weeks before the expiration of that time period. Well, that means they had approximately 75 days. Did they intend to procrastinate and wait until the last minute? And again, when the execution date was set, assuming they intended to file a petition for cert, they should have objected, and sought relief, either from the Supreme Court of California or the Supreme Court of the United States.
