WSP 69th RECRUIT CLASS UPDATE – WEEK 21 This week, the cadets studied cultural competence, testifying in court, and traffic law. The remainder of the week consisted of integration exercises. Integration exercises are real-life scenarios that test the cadet’s skillsets. The week concluded the week with the Phase III test. Sadly, until there is a strong appetite from Judges and law makers to make it a “mandatory” process, we will continue to see this happen. There is also a need for an official formal panel of Mediators that courts can lean on quickly to assign matters. A long way to go but work is being done in the right direction. #adrpaplatform #mediation

Final Payment Notices: A word of caution. I had a careful read of the recent decision in Battersea Development Company v QFS Scaffolding [2024] to understand the rationale of the Judge's thinking on this case and to try and understand what the difference between this case and University of Brighton v Dovehouse [2014] was. As ever the case was decided on the wording of the conclusive evidence clause. in the earlier Dovehouse case the wording only required Adjudication proceedings to be commenced to stop the Final Payment Notice becoming conclusive; whereas in the QFS case the wording required the Adjudication to be concluded. An important lesson here is that, if you receive a Final Payment Notice, then you have to look at the wording of the conclusive evidence clause to work out whether you need to either:- (a) commence adjudication proceedings, or (b) follow the Adjudication proceedings to their conclusion, in order to prevent the nasty effects such a clause may have on your rights to challenge the FPN. You have been warned!
