What does it say about our judicial system if one has to go OUTSIDE OF IT TO SEEK JUSTICE? - The Case Against Judge Welke in Lake County, Florida. Learn more: https://lnkd.in/gywiZDdu THE FAMILY COURT system in our country is plagued by CORRUPTION, especially discriminating against THE POOR, those UNABLE TO SECURE LEGAL REPRESENTATION, or individuals like myself who encounter RACIAL BIASES. Judicial LEGITIMACY is important. Judicial POWER is also important. However, so is judicial RESTRAINT. In my Family Court case, JUDGE WELKE did not honor the RULE OF LAW and the principle of EQUAL JUSTICE for all. Because JUDGE WELKE did not rule from a position of NEUTRALITY, I had no choice but to turn to THE COURT OF PUBLIC OPINION and make my case. JUDGE WELKE is described in YouTube videos as “the most CORRUPT JUDGE in Lake County, Florida” Let us appoint judges to the court, based on their KNOWLEDGE OF THE LAW, THEIR FITNESS FOR THE POSITION AND THEIR FAIRNESS. Let us stray away from appointing judges to the court based on THEIR IDEOLOGY ALONE. #courtlegitimacy #familycourtcorruption #judgefitness #dirtylawyers #crookedattorneys #guardianadlitemabuse #parentalalienation #emotionalabusesurvivor #EQUALJUSTICEFORALL @TheFlaBar @TheBullwork @orlandosentinel @Florida_Bulldog @nytimes @WDBONews @WFTV @WPLGLocal10 @WJXT4 @News6WKMG @WESH @WFLA @WFLANews @MiamiHerald @thedailybeast @everyone @propublica

We welcome the Government's inquiry into the handling of the Andrew Malkinson case. It is important to establish, not only what led to this miscarriage of justice, but what went wrong in relation to Andrew Malkinson's repeated attempts to clear his name. The conclusions of this inquiry will inform our own review of the law on criminal appeals. We have met with Andrew Malkinson and APPEAL, and hope to continue to engage with them and other stakeholders throughout our review. Read more about our project here: https://lnkd.in/d4MBb4Vx

Here is another crucial "What if?" question. What if you’re the victim of police misconduct? If it happens to you, first of all, that sucks. Second, you have several options. To start, you need a civil rights attorney. These attorneys handle lawsuits against police departments for brutality, harassment, excessive force, and other misconduct. Also, make sure you have documented everything. Proper documentation is key to building your case. Additionally, every law enforcement agency has an internal affairs department. Filing a complaint helps improve the agency and brings attention to officers who aren’t doing their job properly. I recommend filing this complaint with the oversight of an attorney; don't file this without speaking to a civil rights attorney first. I've been defending criminal cases here in Central Florida for over 30 years, so trust me, knowing your rights and options is essential. I don't handle civil rights cases like this, but I know people who do, so feel free to reach out and I'll put you in touch with someone. For more legal tips and advice, hit that subscribe button. At the bottom is a link to a thread I wrote on the website-formerly-know-as-twitter about the withdrawal of service by members of the independent criminal bar. I cannot adequately articulate how deeply uncomfortable and, frankly, sad, criminal barristers are to have been put in the position of standing outside courthouses asking for restoration of pay from 2002 levels, in circumstances where every other affected group in the legal sector has been given this. Criminal practitioners at the bar are not money-mad. If we were, we’d be somewhere else. Criminal practice is deeply vocational and requires extraordinary dedication and commitment of your intellectual and emotional energy. We hear the cannon fire and we march to it. Bad things happen inside criminal courthouses but we want to be inside dealing with them. Not standing outside. But fair is fair. The Taoiseach in the Dail today said that it was “always understood” that this situation would be addressed in budget ‘24. That is not the case. The government has not responded to the Bar, despite this withdrawal of service being announced on 12 July 2023, essentially three months ago. The Taoiseach said that the issue has to be linked to reforms. In 2018 the Department of Justice and the DPP agreed that the criminal bar had met all requests and requirements in respect of anything that was asked for. The Taoiseach drew an analogy with the most recent GP contract and referred to a loss of private income. Whereas I am fortunate enough to be briefed frequently in private client work that is exclusively in the civil/regulatory/commercial fields. There is in fact no meaningful private client work on the criminal side, or so little as to make it not a factor. The Taoiseach in drawing this comparison shows a lack of engagement with the real issues. I would go so far as to say that my practice in criminal law has been advantageous to my private clients, in terms of hard-won litigation and oral advocacy skills in an arena where nothing is taken for granted. I don’t speak for my colleagues but that response has only fanned the flames. We can put with a lot but not with a response which we know to be patently disingenuous. If you still frequent Mr Musk’s playground, please do read the thread. If you do or you don’t please support the criminal bar because this is existential and you will miss it if it ever ceases to exist. If you support us please consider expressing your support by liking, sharing and discussing this and similar threads or posts on your social media and, more importantly, in the real world. You can also sign the open letter of support prepared by the Bar Council, which is available at this link: https://lnkd.in/eWsCWGGe Many thanks.
