Generally, the Phase I ESA is the first step in completing environmental due diligence. It involves researching current and previous uses of a property to assess if any actions have impacted soil or groundwater conditions. If you are an owner, developer, lender, or municipality, ESA results are an important starting point when dealing with transactions, property use changes, and much more.

According to a study from the University of Illinois Urbana-Champaign (https://lnkd.in/ghYxgJUq), Carbon Capture and Storage (CCS) development and expansion has the potential to create 14,400 jobs, generating more than $3 billion for the State’s economy over 10 years. This includes the creation of new employment opportunities in the construction industry as well as the operation of new CCS facilities. In the aftermath of SCOTUS's reversal of the Chevron Doctrine, I am reminded of how much the Administrative State has supplanted market-based decision making broadly throughout the economy. This expansion is almost exclusively due to the judicial deference to regulators. In the case of urban planning and land development, substantive evaluation of land-use regulations is almost never subject to judicial review. Court's have abandoned substantive review. Kelo vs. City of New London reinforced this. But these regulations carry significant costs and burdens. My early research, published in the Journal of the American Planning Association, pointed out how regulatory burdens increase transaction costs by creating uncertainty and delay, reducing housing production. https://lnkd.in/efJM9RCY
