Central developments in the legal landscape as JAMS announces their new Mass Arbitration Procedures and Guidelines, following similar updates from the American Arbitration Association, reflecting an anticipated rise in mass arbitration cases in the US. This initiative aims to streamline administrative processes, enhance the flexibility of process administrators’ functions, and standardize filing fees for group arbitration claims. A key resource to meet users’ needs for efficient and fair dispute resolution, these refined and well-measured procedures will apply only if mutually agreed upon by all parties, ensuring integrity in the arbitration process. Kudos to Kimberly Taylor, Chris Poole, and Elizabeth Carter, for spearheading this essential update. While lacking explicit frameworks for mass arbitration, other international arbitral institutions have developed rules for managing multiparty and multi-contract arbitrations, adopting liberal procedural tools, especially in consolidation.
