I had a great time yesterday reconnecting with friends and moderating the debate between Chris Nolland and Jeff Kaplan over whether to start a mediation with any kind of joint session. My takeaways were: (1) there is no one-size-fits-all answer to whether to have a joint session or what kind to have; (2) joint sessions with attorney arguments are rare these days, which may be a missed opportunity for parties to speak directly to each other; (3) a joint session with only the mediator talking can be an efficient way to get the parties committed to the process; (4) a joint session can backfire dramatically; and (5) preparation by the mediator is critical to deciding whether to have a joint session and making sure a joint session helps rather than hurts the process.

The fall is a busy time - but not too busy to miss this great event with a fantastic line up, hosted by my wonderful colleague at the The Bar Association of San Francisco Laura Benghal and the inspiring Donald L Proby. We in the dispute resolution field know very well that increasing #AccessToJustice is indeed about those infrastructural questions like price, timing, and technology. We also know that procedural justice (i.e. how participants participate in and experience the process of justice) has a tremendous role, big enough to sometimes overtake the power of outcomes. That's exactly why after mediating an issue, parties can and do often walk away satisfied with the process even when they did not secure the agreement concessions and terms they hoped for. In the realm of procedural justice, topics like love, compassion, mercy, and freedom often become paramount for parties. Script of my speech today as Chair at the Law Society Dispute Resolution Conference prior to introducing Lord Justice Birss as our keynote. I stress these are my own views on Civil Justice. Was not easy to deliver my points, particularly as things are moving so fast in the FRC area. Plus, it is not a forte of mine but that is no reason to shy away from it. Someone has to make these points. One thing I can see from the keynote he has given today is that Lord Justice Birss has really good intentions and really wants to improve access to justice. His ideas for online portals etc sound promising. Unlike previous reforms, I hope his enthusiasm and drive for positive change can now be properly executed. P.s. He quite rightly didn’t say anything about the FRC because of the ongoing APIL JR. I didn’t think he would. Thank you Lord Justice Birss for contributing to what is hotting up to be an excellent event. I’m calling it the Glasto of Dispute Resolution Conferences.
