How is this not the top headline being discussed by the #cannabisindustry right now!?!?!?!?! I get that it isn't as flashy as Schedule 3, and it isn't as controversial as all the different ways states are trying to plug the "intoxicating hemp" "loopholes." But... Given the precarious nature of how #cannabis sits in the legal landscape today, and how we all seem to think it will play out in the future, this seems like it will have a MAJOR impact on our world. Not sure how/why? Let's break it down: What was it? The Chevron doctrine originated from the 1984 Supreme Court case Chevron v. Natural Resources Defense Council. It mandates that courts defer to a federal agency's interpretation of an ambiguous or unclear statute that the agency administers, as long as the interpretation is reasonable. How did it work? The Chevron doctrine involves a two-step process: first, determining whether the statute is ambiguous; if it is, then the second step is to determine whether the agency's interpretation is reasonable. If both conditions are met, the court must defer to the agency. What happens next? Overturning the Chevron doctrine significantly reduces the deference that courts must give to federal agencies' interpretations of statutes. This could lead to increased judicial scrutiny of agency actions, potentially limiting the power of agencies and shifting more interpretative authority to the judicial branch. Why does it matter in cannabis? 1. If the Chevron deference is eliminated, any decision by the DEA or HHS to reclassify cannabis could face more stringent judicial review. Courts would no longer automatically defer to these agencies' expertise and interpretations of ambiguous statutory terms, potentially leading to more legal challenges and greater scrutiny of the decision-making process. 2. The reclassification process involves interpreting various aspects of the CSA and related health and safety standards. Without Chevron deference, courts might provide a more consistent and uniform interpretation of these laws, which could either support or hinder efforts to move cannabis to Schedule III, depending on how the judiciary views the evidence and statutory language. 3. Agencies like the DEA and HHS would need to provide more robust and detailed justifications for reclassifying cannabis. They would need to ensure that their decision aligns clearly with statutory requirements and withstands potential judicial challenges without relying on deference to their expertise. 4. Eliminating Chevron deference might place more pressure on Congress to clarify or amend the CSA regarding cannabis classification. If agencies face greater judicial scrutiny and uncertainty in reclassification efforts, legislative action might become a more viable and necessary route to achieve policy goals. The developments concerning rescheduling cannabis are happening quickly. My column tries to lay out the process by which rescheduling occurs. Once I learned the entire process, it became clear there's a long road ahead and a lot that can go sideways. Finishing the process before the election is unlikely and a change of administrations could threaten rescheduling altogether. This is cannabis and it's complicated and celebrating anything having to do with rescheduling is premature. It's time for the community and industry to engage with the process, submit public comments, request administrative hearings, and get your lawyers ready for litigation.
