The Shanghai team at Keller and Heckman LLP reports on the latest developments in food labeling regulations as two agencies release drafts of new requirements. On June 27, 2024, China’s National Health Commission (NHC) published a draft of the Food Safety National Standard for the Labeling of Prepackaged Foods (GB 7718-xxxx). The next day, the State Administration of Market Regulation (SAMR) released draft amendments to its Measures for Supervision and Administration of Food Labeling. These key documents address significant changes in food labeling, resulting from years of coordination between NHC and SAMR to streamline responsibilities and optimize label management. Industry stakeholders should closely monitor these developments as they form the regulatory framework for labeling prepackaged foods in China. On June 18, 2024, the U.S. Food and Drug Administration (FDA) issued a final rule that governs current good manufacturing practices (CMPGs), certification, postmarketing safety reporting, and labeling requirements for certain medical gases. These regulations are aimed at fulfilling a longstanding request from the medical gas industry that FDA tailor these requirements to better fit the unique nature of medical gases.
