German financial regulator BaFin has said it is already taking ESMA's new guidelines for ESG fund names into account when processing new applications, despite the rules only formally coming in to force later this year. The regulator said it is "already taking the requirements resulting from the ESMA guidelines into account when processing all new applications" and that the ESMA rules will replace its existing approaches. This means that it will only apply guidelines to sustainability-named funds, whereas previously it had also looked at funds which advertised themselves as sustainable. The news comes as Morningstar Sustainalytics reports 30 Article 8 and 9 funds have dropped ESG terms from their names this year. While some of these appear to be ESMA-related, others relate to strategy changes, however. https://lnkd.in/eAzfKxER

France’s financial regulator will step up its enforcement of the EU’s Sustainable Finance Disclosure Regulation (SFDR) for asset managers that fail to heed its recommendations to achieve full compliance, a spokesperson has confirmed to Responsible Investor. The Autorité des marchés financiers (AMF) – France has ramped up its supervision of sustainable finance regulation this year, publishing three pieces of analysis on supervisory initiatives earlier this month, one of which was its first spot inspection of five French asset managers’ SFDR compliance. In the SFDR study, no French asset manager was found to be fully compliant with the EU regulation at entity or fund-level. Of the 25 Article 8 and Article 9 funds analysed, 60 percent were in breach of SFDR. The spokesperson told RI that each manager will receive a letter detailing the breaches identified and requesting remediation by December. They added that close monitoring upon remediation of breaches will be triggered for the inspected asset managers in the second half of this year. If deliberate lack of remediation is identified, it may lead to an “ad hoc repressive inspection” targeting the recalcitrant managers.
