This does not appear to be what the decision is saying at all. They are saying that the lower courts should have given greater consideration (or, any consideration at all) to separation of powers issues. There seems to be nothing in the holding contesting that the subpoenas are pursuing legitimate legislative purposes, but rather that their overall legitimacy is hinged upon separation of powers: make it too easy for Congress to harass a President for arbitrary (private) records and you've got a big problem. | |
